Williamson Town Board – Oct 3, 2013

A Special Meeting of the Town Board of the Town of Williamson was held in the Town Complex Court Room located at 6380 Route 21, Suite II, and was called to order at 3:00 PM on Thursday, October 10, 2013 by Supervisor James D. Hoffman with the Pledge of Allegiance. The following were present: Supervisor James D. Hoffman, Councilman Anthony Verno, Councilman Gary Orbaker, Councilman Michael Bixby, Councilman Thomas D. Watson. Kevin Schulte, George McConoche, Valarie Fowler; Supervisor’s Secretary, Kurt Allman; Highway Superintendent, Art Williams; Town Attorney, and the undersigned Deputy Town Clerk were also present.
The board authorized the Town Supervisor to sign an intermunicipal agreement with the Town of Sodus to share the services of Al Hendrikse as Building Inspector/Code Enforcement Officer beginning October 10, 2013 through October 31, 2013, upon approval of the Town Attorney.
Discussion was had with the Board, Art Williams; Town Attorney, and Kevin Schulte; with “Sustainable Energy Developments” [SED] regarding the solar project to be installed at the previous landfill site on Pound Road. Atty. Art Williams commented that he was very confident that if the Town should take possession and ownership of the solar energy facility, that they can sell excess electricity to any non-residential entity. Councilman Watson asked a few questions, all were answered to the Board’s satisfaction. Questions and comments were heard.
The board authorized the Town Supervisor to sign a Solar Energy Power Purchase Agreement with Distributed Sun Project Company upon approval of Art Williams, Town Attorney and Bernard P. Donegan, Financial Advisors. The agreement is to authorize the Distributed Sun Project Company to lease property from the Town of Williamson to install, finance, own and operate a solar energy facility and the Town of Williamson agrees to purchase all the energy produced by the system. Discussion ensued. The motion was carried as amended.
The board moved and amendment to change the following sentence to read: The agreement is to authorize the Distributed Sun Project Company to lease property known as the Williamson landfill property located on Pound Road, from the Town of Williamson to install, finance, own and operate a solar energy facility and the Town of Williamson agrees to purchase all the energy produced by the system. The motion to amend was carried.
Supervisor Hoffman made a motion, seconded by Councilman Orbaker, to adjourn the meeting at 3:20 PM. The motion was carried.
