Town of Sodus – Wed., January 8

 Supervisor LeRoy called to order an Executive Session Meeting beginning at 6:00 p.m.

 

EXECUTIVE SESSION:

Councilperson Grey motioned to enter into Executive Session at 6:00 pm to discuss a personnel issue relative to a particular person and pending litigation was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson Pickering motioned to exit out of Executive Session at 6:50 pm was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Town Justice Bob Fratangelo officiated the swearing in ceremony for newly elected Town Councilmember David LeRoy and re-elected Town Councilmember Dale Pickering.  Oaths of Officeswere signed and notarized.

Supervisor Steven LeRoy opened the Regular/Organizational Meeting to order with the Pledge Allegiance at 7:00 pm.

MINUTES

Councilperson DeBadts motioned to approve the Minutes of the December 11, 2013

Regular Board Meeting was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts motioned to approve the Minutes of the December 31, 2013

Year End Board Meeting was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

SUPERVISOR’S REPORT

Councilperson Grey motioned to accept and file the December 2013 Supervisor’s Report (including all town-wide expenditures and compensated absences) was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

TOWN CLERK’S REPORT

The Town Clerk’s Report, Town Clerk’s bank statements for audit, and bank register for December 2013 was presented.  Councilperson DeBadts motioned to accept and file this report, which was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

TAX COLLECTION REPORT

Councilperson Pickering motioned to accept and file the January 2014 Tax Collection Report, Tax Collection bank statements for audit, and bank register was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

JUSTICES REPORTS

Supervisor LeRoy and/or the Board were unable to audit the Town Court for December’s 2013 activity hence, the inability to approve any reports.

YEAR-END REPORTS

Councilperson DeBadts motioned to accept and file Department Head’s Year-End Reports for 2013 was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

PUBLIC SAFETY COMMITTEE:  Councilwoman Kelly Grey, Chair

(Fire, Ambulance, Emergency Preparedness) 

Councilperson Grey gave the December 2013 STAC report.  Grey stated the STAC transition is going well.  Wallington Fire Dept. currently is the only fire department in the Town of Sodus that submitted a year-end report.  January 19, 2014 is the next SESA Meeting.  Sodus Center Fire Department will be holding its monthly roast beef dinners beginning in January.

BUILDINGS AND GROUNDS COMMITTEE:  Councilman David LeRoy, Chair

CODE ENFORCEMENT REPORT:

Councilperson Pickering motioned to accept and file Code Enforcement Officer, Al Hendrikse’s December 2013 Report, which was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

RECREATION/ENVIRONMENTAL COMMITTEE: Councilman Dale Pickering Chair (Recreation, Drainage, Environmental)

Councilperson Pickering stated Recreation had no meeting for December.  Pickering expressed his deepest sympathy for the loss of Pete Peterson.

REGULAR MONTHLY CORRESPONDENCE:

Councilperson DeBadts motioned to appoint Dennis J. Lewis (Innovative Solutions Corp.) to perform regular IT services to the Town of Sodus at a rate of $55.00 per hour, which was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts motioned the Town of Williamson to be designated as Lead Agency (in the SEQRA relative to their salt barn construction on Rt. 104) was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts motioned to advertise for Ad-Hoc members for current and future openings on the Town of Sodus Planning/Zoning Boards was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Supervisor LeRoy and Code Enforcement Officer Al Hendrikse discussed boarding up windows at Plassche Lumber.  LeRoy stated he would contact Kevin Rooney to help with the project.

Councilperson Grey motioned to charge 6450 Shaker Rd (Burt Madison) a minimum bill of $45.00 for any water usage between 0-25,000 gallons.  Any amount over the 25,000 gallons will be charged $3.95 per thousand gallons was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson Grey motioned that 6450 Shaker Rd (Burt Madison) will have an applicable charge annually in the debt service for water was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

(Note: further information needs to be gathered to determine the correct debt service charge for 6450 Shaker Rd.)

Councilperson Grey motioned to reimburse Burt Madison $750.00 for overpayment on a hook-up fee for 6450 Shaker Rd. was seconded by Councilperson Pickering.  Water Superintendent Sean Kennedy stated he discovered that Burt Madison did not have a 2” water hook-up line; rather he had a 1” line.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Supervisor LeRoy and Water Superintendent Sean Kennedy will get together to write a letter to Burt Madison of the following charges for water and the annual charge in the current debt service owed for 6450 Shaker Rd.

Supervisor LeRoy discussed a letter from Barton & Loguidice regarding the repair suggested for the deck of the bridge in Sodus Center.

ORGANIZATIONAL MEETING

 

Councilperson Pickering motioned to set monthly compensation for 2014 Zoning and Planning Board Members to $ 40.00 per member and $ 45.00 per chairperson, which was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts motioned to perform 2013 year-end transfers, which was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts motioned to pay certain Town of Sodus employees on a monthly schedule, which was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Grey to pay Bonds, Notes, Interest, Contracts, Utility, and Insurance Bills prior to audit was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson Pickering motioned to set the date and time for Town of Sodus Regular Board Meetings to the 2nd Wednesday of each month at 7:00 pm and the Workshop Meetings to the 1st Wednesday of each month at 7:00 pm was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Pickering to close the following dates /holidays for the Town of Sodus was seconded by Councilperson David LeRoy.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson DeBadts to set Highway Superintendent’s purchasing authorization to $500.00 was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson DeBadts to set Water Department Head’s purchasing authorization to $500.00 was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson DeBadts to allow designated personnel to attend out of town conferences was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Pickering authorizing Supervisor LeRoy to deposit Interest Certificates when notification is due was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Pickering to authorize Supervisor LeRoy to sign rental agreement with the Village of Sodus for $1,850.00 per month (fiscal year 2014) was seconded by Councilperson David LeRoy.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson Grey authorized to sign contract and pay $2, 250.00 to the Go Getters Club was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Supervisor LeRoy discussed with the Board that the Sodus Golden Ages has disbanded and will no longer be collecting monies from the town on an annual basis.

Councilperson Pickering authorized Supervisor LeRoy to sign the 2014 contract and pay Home Meal Service $3,000.00, which was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts authorized Supervisor LeRoy to sign the 2014 Recreation contract with the Village of Sodus was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Grey to sign the Joy Community Center Agreement for $1,500.00 was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Pickering to pay the Sodus Point Tourism Booth $1500.00 was seconded by Councilperson DeBadts.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

 

A motion by Councilperson DeBadts authorizing payment to the Veteran’s Organizations of $250.00 each was seconded by Councilperson Grey. Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Pickering to sign the Humane Society Contract was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson Pickering to reappoint Town Attorney, Katie Villani at a rate of $150.00 per hour was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson DeBadts to reappoint Town of Sodus Special Prosecutor, Michael Calarco was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

A motion by Councilperson DeBadts to reappoint Town Health Officer Rebecca Wadsworth to a 4-year term was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.  (Note: Supervisor LeRoy will be checking into to see if the Village of Sodus and Village of Sodus Point can combine services with Rebecca Wadsworth as the Health Officer and save on costs).

Councilperson Grey motioned to reappoint Sandy Hopkins as Town of Sodus Historian for 2014 was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson DeBadts motioned to designate the Town of Sodus Bank Depository Lyons National Bank was seconded by Councilperson Pickering.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson Pickering motioned to allow and authorize Town of Sodus Employees to attend Meetings & Conferences relative to their respective departments was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Councilperson Pickering motioned to allow Town Justices to attend meetings of the Magistrates Association and Judicial School was seconded by Councilperson Grey.  Upon roll call the following votes were heard, Steven LeRoy, aye; DeBadts, aye; Pickering, aye; Grey, aye; David LeRoy, aye.  Motion carried.

Supervisor LeRoy appointed Town Council to continue with the same Town Board Committees (David LeRoy will be taking on the Buildings & Grounds Committee).
