Mayor Kleisle introduced Jerry Ashley, Chairman of Peppermint Winter Wonderland. Mr. Ashley discussed the agenda for this year’s festival, which will be held on November 24, 2012 at the Village Square Park. He requested permission to decorate the park and bandstand on November 17, 2012, and use of the fire truck on November 24, 2012, to bring Santa to the park. He also requested the following streets to be closed for the Parade of Lights, which will start at 6:00 P.M. on November 24, 2012. Jackson Street from Phelps Street to Broad Street, to line up the parade, the parade route: Broad Street to William Street to Pearl Street.
Mayor Kleisle suggested the ribbon cutting for the newly renovated bandstand take place the same night. Invites will go to Empire Merchants and Wayne County Chairman, James Hoffman, for their gracious donations toward this project.
Permission was granted for Peppermint Winter Wonderland to use the fire truck decorated to bring Santa to the park on November 24, 2012 and to close Jackson Street from Phelps Street to Broad Street, Broad Street to William Street to Pearl Street for the Parade of Lights.
Mayor Kleisle placed on record the results of the vote: “Shall the Village of Lyons be dissolved?” No votes 524 and Yes Votes 569. This is before the count of the absentee votes.
Mayor Kleisle introduced Michael Welch, owner of 8203 Gristmill Drive. Mr. Welch asked to speak to the Village Board regarding his water bill. His water bill for billing period July, August, September showed a consumption of 76,000 gallons. Mr. Welch disputed this. Mr. Welch did get a new meter. His reader on the outside read 766. When the meter was replaced, the reading was taken from the inside meter which showed 840 The period with the new meter showed 2,000 gallons used for a total consumption of 76,000 gallons. Mr. Welch had several billing periods where zero consumption was recorded. A discussion took place regarding the timeframe the water may have gone through the meter. It was determined to allow 40,000 gallons to be billed at the old rate, because no determination could be made when the actual water was used. Mr. Welch’s water bill, for the property located at 8203 Grist Mill Drive, is adjusted 40,000 gallons at the 2006 rate and 36,000 gallons stay at the current rate for a total refund to him of $132.00.
Permission was granted for the Mayor, Village Board, Police Chief, and Clerk-Treasurer to attend the Wayne County Village Officials meeting to be held November 14, 2012, hosted by the Village of Newark at the Newark Country Club. All expenses to be borne by the Village of Lyons.
The Village of Lyons requests collection of delinquent 2012 Village taxes in the amount of $273,675.85 plus penalty of $24,630.84 (9%) by the County of Wayne pursuant to Wayne County Local Law 4-1978 and Section 1442 of the Real Property Tax Law; the Clerk-Treasurer as authorized and directed to send a certified copy of the resolution together with the account and certification described in Subdivision 3, section 1426 of the Real Property Tax Law and Wayne County Local Law 4-1978.
Clerk-Treasurer, Denise Darcangelis, informed the Village Board Randy LaRue has requested a liquor license for 43 Canal Street. He will be the owner of this establishment under the name “The Pour House”. The establishment will consist of sale of liquor, wine and beer, restaurant, juke box, patron dancing; occasional karaoke bar. This notice has been acknowledged by the Village Board.
Letter of resignation from Jan Mastracy for the position of Water and Sewer Clerk be accepted effective November 21, 2012.
Notification was received from the State of New York Department of Transportation that the posting on the bridge carrying Lyons-Marengo Road over the Erie Canal in the Town of Galen will be lowered from 23 Tons to 3 Tons.
Mayor Kleisle advised the Village Board she received notification from HomeServe that they will be mailing a solicitation for their water service line coverage to residents starting in November. This is not affiliated with the Village of Lyons. This is simply an insurance offer to property owners.
On December 11, 2012, a Public Hearing will be scheduled to be held at 6:00 P.M. at the Village Hall for proposed Local Law 2-2012, a local law to override the tax levy limit established in General Municipal Law §3-c.
Authorization is given to Richard Wunder, Michael Salerno, and Tom Gowan, to attend the Finger Lakes Water Works Conference Winter Meeting, to be held on December 6, 2012, at the Holiday Inn in Waterloo. All expenses to be borne by the Village of Lyons.
A request was received from Sandra Yonker, owner of 110 Broad Street, to set two additional water meters at this location. This is a three family home with only one water meter. Permission was granted to have two additional water meters set at 110 Broad Street, per the request of the owner.
Mayor Kleisle discussed the bid opening for the Sanitary Sewer Pump State SCADA Improvements. Only one bid was received and that was from Colacino Industries, Inc. The bid came in more than what was estimated. Mayor Kleisle stated she talked to Pat Nicoletta from MRB/group. Several factors contributed to the increase in the total of the bid. A discussion took place Mayor Kleisle felt the Village Board needs to meet with the engineer before a decision can be made.
The bid for the Sanitary Sewer Pump Station SCADA Improvements be tabled and a meeting with MRB/group is scheduled to review the alternatives.
Mayor Kleisle informed the Village Board a decision must be made on the purchase of a Sewer Jet. The Village of Newark has assisted us 8 times. General Working Foreman, Michael Salerno, reported he can rebuild one for $50,000 within a 6- month timeframe. If the Village purchases a new one, they are looking at $184,000 and a timeframe of 9 months.
Trustee VanStean questioned if they reach out to Phelps and Clyde to see if this is a piece of equipment that could be purchased together and shared. Trustee Alvaro stated he is not into building on old equipment. Mayor Kleisle feels sharing equipment does not work.
General Working Foreman, Michael Salerno, is authorized to draft a bid for a new sewer jet and formulate numbers to rebuild existing equipment.
Mayor Kleisle stated the Village must make a decision on replacing the vehicle for the Sewer Department that burned in a fire. $10,000.00 was received in insurance money. Permission was granted for the General Working Foreman, Michael Salerno, to look for a Pickup Truck for the Sewer Department.
Chief Bogan presented the monthly police department report for October 2012. On file for future reference.
Mayor Kleisle presented the Code Enforcement report for October 2012. This is on file with the Village Clerk.
Trustee Alvaro presented the Street Department Report. This is on file with the Village Clerk.
Trustee Greco presented the Lyons Fire Department report for October 2012. On file with the Village Clerk.
Trustee Greco presented the membership application for Steven Savage for the Lyons Volunteer Fire Department. Steven Savagewas approved for membership for the Lyons Volunteer Fire Department.
Permission is granted for the Tiger Cub’s to visit the Lyons Fire Department on January 9, 2013 at 6 P.M.
Authorization was granted for Chief Bogan to order Police Officer, Kevin Costello, to return to work, assigned to light duty within the limitations of his medical release on file and utilize him to work on various projects within the Police Department.
