Town of Butler – December 10, 2012

A regular meeting of the Butler Town Board was held on December 10, 2012 at the Butler Town Hall.
The board members present were: David Spickerman, Sr., town supervisor, Philip Wagner, Eugene VanDeusen and Bert Everhart, councilmen. Councilman VanGelder was absent. Robin Jeremenko, town clerk, was taking the minutes. Others present were: Ed Reitz, Scott Stone, Paul Eygnor, Dorothy Wiggins, Trent Fralick, Megan Fralick and Rick Robinson.
Supervisor Spickerman asked for any public participation. There was none.
Minutes from November 12, 2012 meeting were approved.
The following departments submitted their monthly reports for review: The town supervisor, town clerk, justices, code enforcement officer and animal control officer. The following departments read their reports aloud: the highway superintendent and historian. Reports were accepted.
There were no advisory committee reports.
The following correspondence was received and filed:
The Red Creek Library sent a copy of their 2013 budget.
The town received a copy of the Wayne County quarterly sales tax report.
Supervisor Spickerman and the town board received a copy of the New York State Comptroller’s audit report of the justice court. Judge Stone gave Supervisor Spickerman a check for unclaimed bail money. The town board and Justice Stone discussed the required amount of time to hold the bail money.
Supervisor Spickerman gave a copy of the 2013 Wayne County Snow & Ice removal time and material breakdown for the Town of Butler.
Supervisor Spickerman said he had Randy Nodine come to the town hall to look in the town hall’s attic for roof leakage. Mr. Nodine feels the old solar material should be removed before re-insulating the attic. Supervisor Spickerman said the town can have the highway employees remove it or Mr. Nodine. The town board agreed to have the insulation removal done by town highway employees and re-insulate the attic.
The town board discussed canceling the insurance on the 1998 Chevy 4×4 Truck and selling it at state auction or by private bids. Councilman Wagner moved to put a legal notice and a display ad in the shopper for two weeks for bids for the 1998 Chevy 4×4 Truck and to be opened at the next regular meeting. All were in favor.
Permission was granted for Supervisor Spickerman to sign the Environmental Assessment Form for the town of Butler property on Wager Road.
Supervisor Spickerman said the New York State Comptroller’s office came to the town hall to audit the 2013 town budget and the two percent cap procedure.
Supervisor Spickerman and the town board discussed having a year end meeting. Supervisor Spickerman was given permission to pay Wright Construction before the end of December if the project is completed.
The Organizational Meeting is set for January 7, 2013 at 7:00 p.m.
Permission was given for Supervisor Spickerman to make any necessary 2012 budget transfers for the year end to eliminate deficits and such transfers will be on file.
The board approved a transfer of $294.00 from South Butler Light District fund balance to SL25182.4.
Councilman Wagner moved to adjourn the meeting until January 7, 2013 at 7:00 p.m., seconded by Councilman Everhart.
