COMMUNICATIONS:
Mr. Lee Calhoun presented the Town board with more information on Solar Power.
The board authorized Supervisor Colacino to schedule a meeting with Larson Engineers to learn more about Solar Programs being offered in New York State.
Public Hearing – Local Law No 3. for 2012 – Property Maintenance

Supervisor Colacino asked the public for questions or comments.

Mr. Brian Donnelly, 3082 Maple Ridge Road, asked the Town Board to explain what the appeal process is? Attorney Saracino quoted the procedure from section VIII Inquiry by the Town Board on the proposed local law. Mr. Donnelly asked if this Law applies to the Village of Newark. Attorney stated that the Town could never adopt legislation that would directly affect the Village of Newark. Mr. Donnelly asked if farm operations are exempt? Attorney Saracino; “No, nothing is exempt”.
Public hearing closed.

UNFINISHED BUSINESS:
Arcadia Hills LLC – Waiting period for comments from interested agencies, deadline is November 2, 2012.
Local Law No. 3 for 2012 – Property Maintenance was approved for adoption by the Board.

NAVA Contract
Supervisor Colacino was authorized to sign the NAVA Contract designating their coverage area.
1303 North Main Street — Supervisor Colacino asked the Town Attorney to review the Indemnification Agreement for 1303 North Main Street with Lu Engineer, Robert Hutteman and WC Attorney.

NEW BUSINESS:
Water District No. 11 – Out of District User Agreement
The board authorized Albert & Donna Cooley, 7107 Jackson Hill Road to sign an Out of District User Agreement for water District No. 11. All voted aye.

Budget Public Hearing Date
The board will hold a Public Hearing for the 2013 Town of Arcadia Budget at 5:00 PM, Wednesday, October 31, 2012. Also, please note a special meeting will follow immediate after the close of the public hearing.
